A 20-year-old man told a judge in Caroline Circuit Court on Thursday that he was guilty of having sex with a 14-year-old girl last July and the judge gave him no additional jail time other than the three months he had already served.
Kyle Wayne Huffman, now 21, of Bowling Green, got no additional jail time as part of a plea agreement that he made with Caroline’s deputy Commonwealth’s attorney, Diane Abato, to testify against the teen’s father, William Young, 54, of Bowling Green.
Huffman testified against Young in February, saying the teen’s father allowed him to have sex with the teen in exchange for cigarettes, money and rides around town. Young was given a 12-month sentence for misdemeanor contributing to the delinquency of a minor. Young even told Caroline Circuit Court by Judge Patricia Kelly in February that he allowed Huffman to sleep on the floor in his 14-year-old daughter’s bedroom.
Huffman was charged with a class 4 felony and could have gotten two to 10 years in a state penitentiary. He was charged with having carnal knowledge with a child over 13 but under 15 between July 1, 2013 and July 22.
Abato told the judge the plea agreement was acceptable because of Huffman’s “willingness to confess to what he did and testify against William Young” and because “her father said it was OK (to have sex with the teen) and his mother (Huffman’s) said it was OK.
“I do think there was mitigation in that this young adult was guided by the parents of the girl,’ Abato said.
Kelly gave Huffman a 10-year sentence, suspended nine years and nine months.
The judge told Huffman he must not have any contact with the girl—direct or indirect. “If you see her in a store, you get out of that store immediately. Don’t send her any messages. No Facebook. No messages through a friend. If you come up with any way that I have not thought of, don’t do it.”
He must also submit to a DNA analysis and not violate any laws. He must pay court costs and register as a sex offender. “Failure to register is a felony,” Kelly said.
During Young’s trial, Huffman testified that he had slept with Young’s 14-year-old daughter, adding that he had sex with her “nine or 10 times.”
Huffman also stated that he and the teen had sex while her father was in the small second-floor apartment along Maury Avenue in Bowling Green. He had sex with her in other locations too, he testified.
“I didn’t see a problem with it, obviously, because the parents said it was OK,” Huffman testified in February. He quoted Young as saying, “ ‘As long as it was on the down low, it will be OK.’ ”
Huffman testified in February that he had given Young five or six packs of cigarettes and loaned $50 to $70 to him while staying in the apartment 10 to 14 nights, sometimes for three consecutive nights.
Young came in the bedroom once and saw Huffman and the teen in the bed together. They were “in bed, just laying there, sometimes kissing,” when Young saw them, Huffman said during Young’s trial.
